Terms of Service

These Terms of Service (“Terms”) govern your use of Onirica (“the App”), developed and distributed by Matteo Marjanovic (“I”, “me”, or “my”). By downloading or using Onirica, you agree to these Terms. If you do not agree, do not use the App.
1. Who I Am

2. License
Onirica is licensed to you, not sold. Upon purchasing the App through the Mac App Store, I grant you a personal, non-exclusive, non-transferable, revocable license to use Onirica on any Apple-branded device that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.
3. One-Time Purchase
Onirica is available as a one-time purchase. There are no subscriptions, no recurring charges, and no usage limits. You pay once and use the App indefinitely, including all features available at the time of purchase.
Future major updates may be offered as separate purchases at my discretion. Any such changes will be communicated clearly before they take effect.
4. Ownership of Generated Content
Any image you generate or edit using Onirica is yours. I claim no ownership over content you create with the App. You are free to use your generated images for personal or commercial purposes, subject to the terms of the underlying AI model license (Apache 2.0, as published by Black Forest Labs).
5. Acceptable Use
You agree not to use Onirica to:
- Generate, distribute, or store content that is illegal under applicable law, including but not limited to child sexual abuse material (CSAM) or non-consensual intimate imagery (NCII)
- Generate content that infringes on the intellectual property rights of others
- Attempt to reverse-engineer, decompile, or extract the AI model weights or any other proprietary component of the App
- Use the App in any way that violates Apple’s App Store guidelines or any applicable local, national, or international law
Violation of these terms may result in termination of your license to use the App.
6. AI-Generated Content Disclaimer
Onirica uses an AI model to generate images. By its nature, AI-generated content can be unpredictable. I do not guarantee that the App will produce specific results for any given prompt. You are solely responsible for reviewing and using any content generated by the App.
The AI model (FLUX.2 Klein 4B by Black Forest Labs) includes safety fine-tuning to reduce the likelihood of generating harmful content. However, no AI system is perfect. If you encounter unexpected outputs, please contact me at info@getonirica.com.
7. Intellectual Property
Onirica, including its design, code, and branding, is the intellectual property of Matteo Marjanovic. The underlying AI model is licensed under the Apache 2.0 License by Black Forest Labs. Nothing in these Terms transfers any intellectual property rights to you beyond the limited license described in Section 2.
8. No Warranty
Onirica is provided “as is” and “as available” without warranties of any kind, either express or implied. I do not warrant that the App will be error-free, uninterrupted, or meet your specific requirements. To the fullest extent permitted by applicable law, I disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Onirica, even if I have been advised of the possibility of such damages. My total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App.
10. Governing Law
These Terms are governed by the laws of Italy, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Verona, Italy, unless otherwise required by applicable consumer protection law in your country of residence.
11. Apple as Third-Party Beneficiary
You acknowledge that Apple is a third-party beneficiary of these Terms and has the right to enforce them against you as a third-party beneficiary. In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, the Apple terms shall prevail with respect to your use of the Mac App Store.
12. Changes to These Terms
I may update these Terms from time to time. If I make material changes, I will update the “Last updated” date at the top of this page. Continued use of the App after changes constitutes your acceptance of the updated Terms.
